At QuikLearn, we are committed to safeguarding our users’ privacy while providing a personalized and valuable service. As reflected in our privacy policies, we use the data of our customers and users to provide support and continually improve our products and services, and to inform our customers and users about those products and services. We are committed to protecting the privacy and security of the data of our customers and users, and to working with service provider partners that are similarly committed to the protection and privacy of personal data they process on our behalf.

  1. Overview. This Privacy Policy explains the relevant data practices of QuikLearn as it relates to users and customers. We are committed to the privacy and security of the personal information we receive and process in accordance with applicable legal requirements. If you have requests concerning your personal information or questions about these practices, please contact our legal department via e-mail at legal@view-software.com. We encourage you to periodically review this Privacy Policy as it may change at any time, in our sole discretion. In the event you provide us with personal information for the purposes of free registration and you later make a purchase, whether directly from us or facilitated by one of our e-commerce partners, your privacy rights will be protected according to our stated policies and the stated privacy policies of our partners, which will be posted and available for your review at the time of purchase.

  2. Data Collection. QuikLearn collects data, including some Personal Data. QuikLearn collects data through: (a) the use of registration or inquiry forms; (b) the purchase process when you buy any of our products or services; or (c) the provision of your details to us either online or offline. The elements of your data that we collect may include: (i) contact information, such as name, email address, phone number, and physical address; (ii) location information; (iii) contacts; (iv) user content, such as emails or text messages, photos or videos, gameplay content, and customer support; (v) browsing history; (vi) search history; (vii) identifiers, such as user ID and device ID; (viii) purchase history; (ix) usage data, such as product interactions and advertising data; and (x) diagnostics, such as crash data and performance data.

  3. Data Use. QuikLearn uses data it collects for the following purposes: (a) developer’s advertising and marketing, such as displaying first-party ads in our App, sending marketing communications directly to users, or sharing data with entities who will display our ads; (b) analytics, such as using data to evaluate user behavior, including to understand the effectiveness of existing product features, plan new features, or measure audience size or characteristics; (c) product personalization, such as customizing what the user sees, including a list of recommended products, posts, or suggestions; (d) App functionality, such as to authenticate the user, enable features, prevent fraud, implement security measures, ensure server up-time, minimize App crashes, improve scalability and performance, or perform customer support; and (e) other purposes, such as resolving disputes, collecting fees, and troubleshooting problems (for example, we use the information you provide to us when placing an order to complete that order). We do not share your data with outside parties, except: (i) to the extent necessary to complete an order or to provide you with services by way of our service providers (e.g., payment processing, third-party shipping, business analytics, customer support); (ii) in accordance with legal and regulatory requirements; (iii) as necessary, in QuikLearn’s sole discretion, to protect the perceived rights, safety and property of QuikLearn, users, and the public; or (iv) with affiliate or subsidiary entities of QuikLearn to manage and control Personal Data as joint users. Other than as set out above, you will be notified when Personal Data about you will be shared with third-parties and you will have an opportunity to choose not to have us share such information. Also, we use information we gather in aggregate form so that no individual user is identified. This information may be used to: (A) aid strategic development; (B) build up marketing profiles; or (C) audit usage of the mobile App.

  4. Use of Cookies and Other Tracking Devices. The QuikLearn App may use Cookies and other tracking devices, including local shared objects, to help personalize your use of our App. If you do not want to help us improve our App, products, offers and marketing strategy, you may choose to not accept cookies. A Cookie is a small piece of information; this information may include information relating to your use of our sites, information about your computer such as a mobile device’s browser type, demographic data and, if you arrived at our site via a link from a third-party site, the URL of the linking page. If you are a registered user, this may include your name and email address for verification purposes. We use information from Cookies for purposes that may include: (a) identifying returning users and registrants; (b) enabling you to move more easily around our mobile App; (c) tracking your use of our site to better develop our sites in accordance with your requirements; or (d) building up a demographic profile. From time-to-time we may permit third-party companies to set Cookies on QuikLearn’s mobile App for purposes that may include market research, revenue tracking, or to improve functionality of the mobile App.

  5. Security Policy. QuikLearn has appropriate measures in place to help ensure that our user’s Personal Data is protected against unauthorized access or use, alteration, unlawful or accidental destruction and accidental loss. Although we make reasonable efforts to protect your Personal Data from loss, misuse, or alteration by third-parties, you should be aware that there is always some risk involved in transmitting information over the Internet. There is also some risk that thieves could find a way to thwart our security systems.

  6. Access to Data and Contact Information. Where required by applicable law, including GDPR, you have the right to obtain confirmation of the existence of certain personal data relating to you, to verify its content, origin, and accuracy, as well as the right to access, review, port, delete, or to block or withdraw consent to the processing of certain personal data (without affecting the lawfulness of processing based on consent before its withdrawal), by contacting us. You have the right to object to our use of personal data for direct marketing and in certain other situations at any time. Contact us for more details. Please note that certain personal data may be retained as required or permitted by applicable law. If you are a User receiving access to our Services through a corporate, governmental, educational, or other Enterprise Client of QuikLearn, and you wish to request access, limit use, limit disclosure, or remove your (end-user) Personal Data, please contact the Enterprise Client organization that submitted your personal data to us, and we will support them as needed in responding to your request. If you are contacting us to request information or action with respect to Personal Data we have collected about you, or to exercise your data protection rights, please submit your request(s) through our Chief Privacy Officer by email at legal@view-software.com. If you have other questions or requests concerning your Personal Data, please contact us by email at legal@view-software.com. As noted above, you can choose to not provide QuikLearn with personal information, although it may be needed to register as a member on the Service and to participate in certain features offered through the Service. You may stop the delivery of commercial email communications that QuikLearn may sends you by following the instructions accompanying a particular communication. We may charge the allowable fee under applicable law for providing this information.

  7. Minors Under 18. We do not intentionally collect any information on children under 18 years of age. We will undertake to delete any details (except for the parent or guardian’s email address) of such users where a parent or guardian has notified us that any such details have been obtained.

  8. Definitions.
    1. Personal Data: any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
    2. Cookies: cookies are text files (letters and/or numbers) that contain information packets that are stored on the User’s computer or mobile device every time he/she visits a website through a browser or through a web app or mobile App. At each subsequent visit, the browser sends cookies to the website or mobile App that originated them. Cookies can be stored only for the time of use of a specific site (i.e., session cookies), or for a longer period of time independent of the session (i.e., persistent cookies).
    3. Platform: a learning platform accessible through a mobile App, our website, or wherever the Services are provided.
    4. Services: services provided through the Platform, which allows various forms of interaction between Users, which includes, but is not limited to the possibility of a Teacher building and delivering interactive and engaging learning paths, as well as organizing and managing a virtual classroom for live lessons and a chat.
    5. Users: all users of the Platform, such as Teachers, Learners, and Parents.
    6. Teacher: teachers who use the Services to carry out educational or training courses for their Learners, within private groups.
    7. Learner: learners who use the Services to participate in the educational or training courses of their teachers, within private groups.
    8. Parent: parent and/or guardian exercising parental responsibility of a Minor Learner who intends to use the Services.
    9. Information: information on the processing of Personal Data and information on the Cookies that make up this document. This Privacy Policy does not concern any processing of Personal Data conducted through any third-party sites, pages, or online services of third-parties, accessible by the User via links on the Platform.
    10. Over 18 Learners: Learners aged at least 18 years.
    11. Minors/Underage Learners: Learners under the age of 18 who access the Services by virtue of specific Parent authorization.
    12. GDPR: EU Regulation 2016/679 of 27 April 2016. GDPR only applies to Personal Data processed in one of two ways: (i) Personal Data processed wholly or partly by automated means (or, information in electronic form); and (ii) Personal Data processed in a non-automated manner which forms part of, or is intended to form part of, a ‘filing system’ (or, written records in a manual filing system).     13. Profiling: analysis with automated systems of personal aspects and navigation data, for evaluation and predictive purposes.
    14. School: school of any order or grade in which the teachers work, for whatever reason, and that is attended by the Learners (i.e., the students/pupils of the School).
    15. Enterprise Customer: a company, business, or other organization (e.g., governmental or educational) that has signed a separate user agreement or subscription agreement with QuikLearn in order to use the Platform for the purpose of receiving language training assistance and/or to market or distribute the Platform or Services.

  9. Changes to this Policy. This policy is effective as of February 1, 2022. From time to time, we may make changes to this Privacy Policy to reflect any changes to our privacy practices in accordance with changes in legislation, best practice, or product and service enhancements. We will notify you about material changes to this Privacy Policy by placing a prominent notice within the App.
